This legislation goes into effect in November of 2026, and differentiates between hemp plant and cannabis plants as follows: 

  • Hemp plants are a variety of the cannabis plant containing less than 0.3% THC. Hemp-derived CBD products are federally legal in the U.S. Prior to November 2026, they must be formulated with hemp containing less than 0.3% Delta-9 THC. After November 2026, they must be formulated with hemp containing less than 0.3% total THC, and finished products cannot contain more than 0.4% THC per package. This change largely affects Full Spectrum CBD products, not Broad Spectrum CBD or CBD Isolate.
  • Cannabis (marijuana) plants contain higher levels of THC and are regulated differently depending on state law. Some states have legalized marijuana for recreational use, some states have legalized it only for medical use, and some states don’t allow for any sale or consumption of cannabis plants.
